At Afremov Gallery, we offer original artworks created by independent artists, gallery artists, and other authorized creators.

We believe in transparency regarding the ownership, originality, and intellectual property rights associated with the artworks we sell.

Original Artwork

An original painting is an individually created, hand-painted work of art.

Each physical painting is a distinct original artwork, even when an artist creates additional paintings based on the same or similar composition, subject, or artistic concept.

The terms "Original Painting," "Original Oil Painting," and "One-of-a-Kind Original" refer to the individual physical artwork being offered, unless exclusive rights to the composition are expressly stated.

These terms do not, by themselves, guarantee that the artist has never created or will never create another version of the same composition.

Ownership and Copyright

When purchasing an original painting from Afremov Gallery, the buyer acquires ownership of the specific physical artwork purchased.

Ownership of a physical painting does not automatically transfer copyright, reproduction rights, intellectual property rights, or exclusive rights to the underlying image or composition.

Unless expressly stated otherwise in writing, all such rights remain with the artist or other lawful copyright holder.

Artist's Right to Create Additional Works

The artist or lawful copyright holder retains the right, subject to applicable law and existing agreements, to:

• Create additional original paintings based on the same or similar compositions.

• Produce new versions, interpretations, or variations of previously created artworks.

• Create artworks in different sizes, colors, or artistic techniques.

• Authorize reproductions, prints, and other editions.

• License or otherwise commercially use the artwork's image.

The creation or sale of another individually hand-painted version of a composition does not, by itself, affect the authenticity or original status of a previously purchased painting.

One-of-a-Kind Artwork

A one-of-a-kind original is a unique physical artwork individually created by an artist.

Unless expressly stated otherwise, this designation does not grant the purchaser exclusive ownership of the artistic composition or prevent the artist or lawful copyright holder from creating additional versions.

Each individually hand-painted artwork remains a distinct physical work of art.

Exclusive Rights

Exclusive rights, including copyright ownership, reproduction rights, or contractual restrictions on future versions, are included only when expressly granted through a separate written agreement or other legally effective written transfer by the authorized rights holder.

No such rights are transferred automatically through the purchase of a painting.

Certificates of Authenticity

A Certificate of Authenticity confirms the classification and authenticity of the specific artwork to which it relates.

Unless expressly stated otherwise, a Certificate of Authenticity does not transfer copyright, reproduction rights, or exclusive rights to an artistic composition.

General Notice

By purchasing artwork from Afremov Gallery, customers acknowledge the distinction between ownership of a physical artwork and ownership of the intellectual property rights associated with its image or composition.

Nothing in this policy limits any non-waivable rights available to consumers under applicable law.
